1. Acceptance of Terms

The PreThinkAI application (the “Service”) is operated by PreThink Labs e.U., trading as PreThinkAI (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PreThink is an AI-powered prompt engineering tool that helps users create, refine, and score prompts for use with AI models. The Service includes prompt generation, AI output evaluation, session history, scoring, gamification features, and AI coaching.

3. Beta Disclaimer

The Service is currently in beta. Features may change, be removed, or experience downtime without notice. The Service is provided on an “as-is” and “as-available” basis. We make no warranties regarding uptime, reliability, accuracy of AI outputs, or fitness for any particular purpose during the beta period.

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information when registering.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use the Service to generate harmful, abusive, hateful, or misleading content
  • Interfere with or disrupt the integrity or performance of the Service
  • Share your account credentials with third parties
  • Use automated means (bots, scrapers) to access the Service without authorization

6. Intellectual Property

Our Property: The Service, including its design, code, branding, and underlying technology, is owned by PreThink and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Your Content: You retain ownership of the prompts, context, and other content you submit to the Service (“User Content”). By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the Service.

AI-Generated Outputs: Outputs generated by the Service using AI models are provided for your use. We do not claim ownership of AI-generated outputs. However, we make no guarantees regarding the originality, accuracy, or legal protectability of such outputs.

7. Payments, Refunds and Merchant of Record

Access to the Service is available through a monthly or annual subscription. Our order process is conducted by our online reseller Stripe Payments Europe, Ltd. (“Stripe”). Stripe is the Merchant of Record for all our orders. Stripe provides all customer service inquiries relating to payments and handles refunds.

Refunds: We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund within 30 days of your order date. To request a refund, contact us at help@prethinkai.app. You can cancel your subscription at any time from your account; cancellation takes effect at the end of the current billing period.

8. Limitation of Liability

To the maximum extent permitted by law, PreThink and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

10. Indemnification

You agree to indemnify and hold harmless PreThink and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (e.g., limitation of liability, indemnification) will continue in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. The courts of Vienna, Austria shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection rights you may have under the law of your country of residence.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
